Viibella is an online creator monetization platform that enables approved creators (“**Creators**”) to publish and monetize content and enables users (“**Fans**”) to view such content by purchasing subscriptions, pay-per-view items, tips, and other paid digital access (collectively, “**Paid Content**”).
2.2. The Platform hosts and distributes user-generated content, including adult and sexually explicit material. The Platform is strictly intended for adults only.
2.3. You may only access or use the Platform if you:
are at least *18 years old**, and
* have reached the age of majority in your jurisdiction, if it is higher than 18.
2.4. By using the Platform, you affirm that you meet these age requirements and that viewing adult content is legal in your location.
2.5. We do not produce, direct, or control the content posted by Creators; Creators are independent users who are responsible for complying with all applicable laws and these Terms.

3. Eligibility and Account Registration
3.1. To use most features of the Platform, you must create an account as either a Fan or a Creator, provide accurate registration information, and keep your details up to date.
3.2. You agree to:
* provide truthful, accurate, and complete information;
* maintain the confidentiality of your login credentials; and
* immediately notify us of any unauthorized use of your account.
3.3. You are responsible for all activity occurring under your account. We may suspend or terminate your account if we suspect or detect any breach of these Terms or misuse of the Platform.
3.4. Creators may be required to complete identity and age verification (KYC) and provide additional documentation before they can monetize content or receive payouts. Failure to pass verification may result in denial or limitation of access to Creator features.

4. Roles: Fans and Creators
4.1. Fans
Fans use the Platform to browse profiles, follow Creators, and purchase access to Paid Content via subscriptions, pay-per-view posts, tips, or other paid features.
4.2. Creators
Creators use the Platform to upload, publish, and monetize content including photos, videos, text, audio, and other materials (“**Creator Content**”). Creators set their own prices and offerings within the parameters we provide.
4.3. Viibella acts as an intermediary providing the technical infrastructure for hosting, access control, payment processing via third-party providers, and account management. We are not a party to any direct contract between Creator and Fan, other than providing the Platform as a service.

5. User Conduct and Platform Rules
5.1. You must not:
use the Platform for any *illegal** purpose or in violation of any applicable law or regulation;
* attempt to access accounts, data, or systems you are not authorized to access;
* interfere with or disrupt the operation, security, or performance of the Platform;
* use any automated tools (bots, scrapers) except as permitted by us in writing.
5.2. In connection with Creator Content and other activity on the Platform, you must not:
post, upload, or share any content involving any person *under 18 years of age**, or that could reasonably be interpreted as depicting a minor, including “young-looking” performers represented as under 18;
* post non-consensual content, “revenge” content, hidden-camera content, or any other material created or shared without informed consent of all persons shown;
* post content that is violent, exploitative, or otherwise illegal under applicable law;
* engage in or promote prostitution, trafficking, or any arrangement that violates local laws;
* share or request personal contact details with the intention of moving paid adult services off-platform in a way that breaches these Terms or local law;
* harass, abuse, threaten, or impersonate others.
5.3. We reserve the right, but have no obligation, to monitor content and behavior on the Platform and to remove content, restrict features, or terminate accounts at our discretion if we believe there is a breach of these Terms or risk to Viibella, other users, or third parties.

6. Content Ownership and License
6.1. Creator Ownership
Creators retain ownership of the intellectual property rights in their Creator Content, subject to the limited licenses granted in these Terms.
6.2. License Granted to Viibella
By uploading or posting Creator Content on the Platform, you grant Viibella a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to:
* host, store, reproduce, distribute, display, and perform the Content on and in connection with the Platform;
* use and display the Content for Platform operation, content delivery, promotion of the Creator’s profile within the Platform, and showcasing Platform features.
This license exists for as long as the content is available on the Platform and for a reasonable period thereafter for backup, compliance, and dispute resolution.
6.3. License to Fans
When a Fan purchases access to Paid Content (via subscription, PPV, or other paid feature), the Fan receives a limited, personal, non-transferable, revocable license to view that content for personal use only through the Platform’s interface.
6.4. No Download or Redistribution
Unless explicitly enabled via a specific feature, Fans and Creators must not:
* copy, record, screenshot, screen-capture, download, redistribute, or exploit any Content outside the Platform;
* share or publish any Creator Content on other websites, social networks, or messaging platforms without express permission of the rights holder.
6.5. DMCA / Copyright Complaints
If you believe any content infringes your copyright, you may contact us at [insert legal contact email] with sufficient information to identify the content and prove your rights. We may remove or disable access to alleged infringing material and may terminate repeat infringers.

7. Pricing, Payments, and Payouts
7.1. Payment Processor
All financial transactions on the Platform (subscriptions, tips, PPV, etc.) are processed by one or more third-party payment processors (such as CCBill or other providers we may use from time to time). We do not store or process full card details on our own systems.
7.2. Fan Payments
Fans agree to:
* pay the applicable prices for subscriptions, tips, and other purchases;
* authorize recurring billing where a subscription is set to renew;
* ensure sufficient funds and valid payment methods.
7.3. Creator Earnings and Commissions
Creators acknowledge and agree that:
Viibella charges a *service fee/commission** on all earnings, calculated as a percentage or fixed fee per transaction as shown in the Platform dashboard or relevant policy;
* we may adjust fees with reasonable notice;
* earnings shown in the dashboard may be subject to reconciliation, chargebacks, and processor fees.
7.4. Payouts
Creator payouts:
* are made to the payout methods we support and approve (e.g. bank transfer, e-wallets, or processor-specific settlement);
* are subject to minimum payout thresholds and processing schedules;
* may be delayed or withheld if we suspect fraud, breach of these Terms, chargebacks, or legal issues.
7.5. Taxes
Creators are solely responsible for:
* determining and paying any taxes (income, VAT, sales tax, etc.) due on their earnings;
* reporting income to the relevant tax authorities.
Viibella may, where required by law, withhold or report sums to tax authorities.

8. Refunds, Chargebacks, and Disputes
8.1. As a general rule, all purchases are final and non-refundable, except where required by law or where we decide at our discretion to issue a refund.
8.2. Fans should review content previews, descriptions, and Creator information before purchasing. Digital access is deemed consumed at the moment the content is made available.
8.3. If a Fan believes a transaction was unauthorized or fraudulent, they must contact us promptly at [support email] and/or the relevant payment provider.
8.4. In the event of chargebacks or disputes:
* we may suspend or reverse Creator earnings associated with disputed transactions;
* we may charge the Creator for any fees imposed by the payment processor;
* repeated disputes or excessive chargebacks may result in account suspension or termination.

9. Prohibited Content and Enforcement
9.1. The following content is strictly prohibited and may lead to immediate removal and account termination:
Any depiction of *minors** or individuals who appear to be under 18;
* Non-consensual or coerced acts;
* Content involving trafficking, exploitation, or real harm;
* Hate speech or incitement to violence;
* Bestiality or any other content illegal under applicable law;
* Doxxing, sharing personal data, or threatening or blackmailing others.
9.2. We may, at our discretion:
* remove or restrict access to any content;
* suspend or terminate user accounts;
* cooperate with law enforcement where we believe there is risk or evidence of illegal activity.

10. Platform Availability and Changes
10.1. We aim to keep the Platform available and functional but do not guarantee uninterrupted or error-free service.
10.2. We may:
* modify, update, or discontinue any part of the Platform;
* apply updates and patches;
* introduce new features or remove existing ones;
with or without prior notice, provided such changes do not unreasonably deprive users of paid entitlements without appropriate remedy.

12. Limitation of Liability
12.1. To the maximum extent permitted by law, Viibella, its directors, officers, employees, and agents shall not be liable for:
* any indirect, incidental, special, consequential, or punitive damages;

14. Termination

* your use poses a risk to us, other users, or third parties;

14.3. Upon termination:
